These Terms of Sale apply to all offers made by us, all purchases and orders placed by you and all agreements concluded between us in relation to the products and services offered on this Website. These Terms of Sale are a part of our Terms of Use.


Returns. If you wish to return an item, please see our Return Policy.


Pricing. We work hard to ensure the accuracy of pricing on this Website, but despite our best efforts, pricing errors occur. If the price you are charged for any item is higher than the price posted or advertised, we will promptly refund the difference. If an item’s correct price is higher than our stated price, we will, at our discretion, contact you for instructions before shipping or, cancel your order and notify you of such cancellation. Prices may vary in Alaska and Puerto Rico.


Product Descriptions. Occasionally, a small number of items on this Website may be mispriced, described inaccurately or unavailable, and we may experience delays in updating information on this Website and in our advertising on other sites. As a result, we cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability and services. We reserve the right to change or update information and to correct errors, inaccuracies or omissions at any time without prior notice. We apologize for any inconvenience.


Colors. We strive to display the colors of the products shown on this Website accurately; however, because a monitor’s display may vary from the colors shown, we cannot and do not guarantee that your monitor’s display of any color will be the actual color of the products.


Cancel an Order. If you want to cancel an order, you may cancel within 2 hours of the purchase you want to cancel as long as the item has not been made. Please contact us through the contact page to confirm that your product has not been made.


Quantity Limits. We offer products and services to consumers. We are a retailer, not a wholesaler, and do not sell to individuals or dealers for the purpose of resale to others. We reserve the right, in our sole discretion, to reject an order or otherwise limit the quantity of items purchased per person, per household, per account, per credit card, per shipping/billing address, or per order in our stores and


Sales Tax. Because we do business in all 50 states, we are required by law to collect all state and local sales taxes based on the destination of the order, whether the sale was made in a retail store, by phone, or via this Website. The Internet Tax Moratorium only provides that no new taxes can be applied to the internet itself and charges for Internet services, such as access charges. However, the Internet Tax Moratorium does not affect sellers who use the Internet as a medium to market their products. These sellers are subject to the same rules that have always applied, which means that sellers with a presence in a state must collect the state sales tax. Where applicable, sales tax is charged on shipping and handling for all orders. Tax rates are determined based on the delivery address of the order. Orders mailed to APO/FPO/DPO addresses are not subject to sales and use taxes and will be refunded if charged. TAX RATES ARE SUBJECT TO CHANGE AT ANYTIME.

There is no judge or jury in arbitration and court review of an arbitration award is very limited. The scope of discovery is more limited in arbitration than in court.  However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms of Use as a court would.
To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to Complete Day Journals, Attn LEGAL, 1911 SW Campus Dr. #268, Federal Way, WA 98023. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Consumer Arbitration Rules.  Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The AAA's rules are available at Payment of all filing, administration and arbitrator fees will be governed by the AAA's rules. We will reimburse all such filing, administration and arbitrator fees for claims totaling less than $10,000 unless the arbitrator determines the claims are frivolous. Likewise, Complete Day Journals will not seek attorneys' fees and costs in arbitration unless the arbitrator determines the claims are frivolous. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the county where you live or at another mutually agreed location.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.  We each hereby waive our right to participate in any class action, whether in court or arbitration. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial.


Waiver and Severability

No waiver by Complete Day Journals of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Complete Day Journals to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Entire Agreement

The Terms of Use and our Privacy Notice

Information from your computer or mobile device

We and our third-party service providers (“Service Providers”) may automatically collect information from your device when you visit our websites, use our mobile applications, or use our in-store guest Wi-Fi service. If you consent to using in-person Wi-Fi service, we automatically collect:

•      Usage data (e.g. number of users by store, the websites visited while using the service);
•      Session data (e.g. how long a user stays on the guest Wi-Fi service), device and browser data (e.g. type of device, Device ID, type of browser, IP address); and
•      Precise, real-time information about the location of your device. 

In addition, if you consent, we may also collect precise location information (using GPS, Wi-Fi, or cell tower triangulation, or a combination of these technologies) when you use our mobile applications.

We rely on the following technologies to collect the information listed above, including: cookies, web beacons, and mobile device geolocation to provide and improve our Services and advertising, including across browsers and devices (also known as cross-device linking). We also use this information to verify that consumers meet the criteria required to process their requests and for reporting activity on our Services. For example, we may want to know how long the average user spends on our Services or which pages or features get the most attention. This automatically collected information may be combined with information that is personally identifiable in order to personalize our Services and advertising to your interests, including across browsers and devices. Using technology

We may use or rely on the following technologies to assist us while collecting information, examples include but are not limited to:

•      Web tags: Also called a pixel tag or a clear gif is a piece of code in website pages and in emails, advertising, and other marketing communications that allows us and our third-party service providers to determine whether you have performed specific actions. When you access those pages or open email messages, or click on advertising, the web beacons generate a notice of that action for us, or our service providers. That information is used to analyze what our visitors like to do on our site or mobile applications, and the effectiveness of our features and advertising, as well as interactions with our e-mail and advertising.
•      Wireless beacons: A wireless beacon is a small device that we may use as part of our in-store experience. Wireless beacons broadcast a signal that can be received by compatible devices, such as a mobile phone or tablet, when those devices are within the proximity of the beacon. When you choose to use the Complete Day Journals mobile application, we and our service providers may use wireless beacons in conjunction with the Complete Day Journals mobile application or mobile website to personalize and enhance your in-store shopping experience and to understand your interests so that we can provide relevant notifications, offers, and promotions.
•      Analytics services: Complete Day Journals uses third party analytics companies to collect and analyze information about how people use our websites and mobile applications, including information about browsing and buying activities. They may collect and use information from first- and third-party cookies. In addition, analytics companies also provide services that analyze information regarding visits to certain portions of that are operated for Complete Day Journals by third parties. They use cookies and web beacons to collect this information.

In addition to the information we collect to offer, improve, and provide our products and Services, Complete Day Journals may use personal information for administrative and, analytical purposes such as information systems management, accounting, billing and audits, credit card processing and verification, consumer-relations correspondence, and/or operation of any Complete Day Journals Rewards program that may be offered. Complete Day Journals also uses personal information to identify and market products, coupon offers and services that we believe you will value, including across browsers and devices, in accordance with applicable laws.

Complete Day Journals does not share personal information with third parties except as stated in this privacy notice. We may disclose information to companies affiliated with Complete Day Journals and/or unaffiliated third parties (i) to provide the products and services you have requested; and (ii) for administrative, analytical, and marketing purposes. Complete Day Journals does not sell your personal information for monetary payment. Complete Day Journals does share your personal information with affiliates, licensees within the Complete Day Journals family of businesses, and third parties to better offer you products and services. Authorized Agents

Only you or your authorized agent may make requests. To submit a request as an Authorized Agent on behalf of a consumer, you must submit your name, address, email, and phone number as well as the name, address, email and phone number of the Consumer you are making a request on behalf of. As an Authorized Agent you will also be required to certify that you have the right to make this request on behalf of the Consumer. Complete Day Journals will use the Consumer’s information to search our systems and determine if we have information about the Consumer. If we are able to locate information about the Consumer, will fulfill the request to disclose and/or delete the Consumer’s Personal Information.

Business and commercial purposes

We may use (and may have used during the 12-month period prior to the effective date of this Privacy Notice) personal information about you for the purposes described in the "Using information we collect" Using information we collect section of this notice and for the following business or commercial purposes:
